Probation for Teen in Nude Photos

TRENTON, N.J. (June 24) -- A 14-year-old New Jersey girl who posted nude pictures of herself on MySpace.com will have child pornography counts dropped.
The Passaic County Prosecutor's Office says the girl must undergo at least six months of counseling and probation and must stay out of trouble. If she does, all charges will be dropped.

The Clifton teen was initially arrested and charged with possession of child pornography and distribution of child pornography. If convicted on those counts, she could have been required to register as a sex offender.

For real??? There are actually real sex offenders out there and they wanna arrest a girl who took pics of herself and put them on myspace??? sex crime police must be real bored. and where the hell is this girls parents? i know when i was her age i had parental controls on the internet and the computer was in a location where my parents could keep an eye on what i was doing.

Well there should be a punishment, but honestly, it shouldn't child pornography. If you pinned child pornography on a girl who posted pictures of herself, then you're pinning her as a sex offender, a title she's going to have to carry for the rest of her life.

I'm glad the charges were dropped.

I agree with you. I'm glad the charges were dropped. Although, she deserves a punishment for this, it certainly shouldn't be to have to be tagged as a sexual predator the rest of her life. People will think she touches little kids or something.

I saw a Law & Order SVU episode that was something just like this, although the girl was actually charged with possession & distribution of child pornography when she sent a picture text of herself naked to her boyfriend which sent it to everyone in school after they broke up. It was probably based off of this.

i don't think she should be charged for child pornography, as she willingly took the pictures herself and posted them. it was a fucking stupid idea to put them on myspace.

Personally, I don't think that the police are "real bored"--I think they're upholding the law they've been charged to enforce.

“child pornography” means any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where—
(A) the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;
(B) such visual depiction is a digital image, computer image, or computer-generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; or
(C) such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.

If this adolescent girl was posting naked pictures of herself on MySpace (or anywhere else for that matter) for all to see, then it's distribution of child pornography. Even simply taking down the photos will not remove them entirely from the internet. All anyone has to do is to follow the original path (under "properties") that the image was stored on in order to display it on MySpace and they will be able to pull up a ghost image for quite a while (until all of the servers and back-ups refresh and actually terminate the photo--which can take weeks/months).

While some people may argue that it's not child pornography since the child itself posted the pictures, such arguments should be revisited in the light that the definition of child pornography does not specify HOW the pornography came into existence, it merely recognizes the material itself.

The police in question were doing their jobs and while I understand and appreciate the leniency of the court, it was fully within their legal rights/obligations to take this to court and potentially enforce the full punishment. Were I involved in the case I would also recommend 6 months of counseling to the teen. There is no reason a 14 year old should be posting naked photos of themselves anywhere and there is likely an influence/self-esteem issue that needs to be addressed and resolved.

Just my 2 cents.

Well I mean, look at the 15 or 16 y.o girl who sent nudes of herself to her boyfriend, they broke up and he sent them to EVERYONE. She killed herself. And there was talk about charging all of those kids with child pornography charges. Possession, distribution, etc. I'm glad that she didn't get away with a slap on the hand, because in all honesty she needs to realize the importance of the situation. If she continues to post pictures of herself while she's under age... knowing the consequences, she SHOULD be charged. But not right off the bat.

I agree that she should be punished, but telling her if she doesn't meet these requirements then she'll have to register as a sex offender for posting pictures of HERSELF is ridiculous. just because she posted pictures of HERSELF naked, doesn't mean she'd do it to someone else. Freaking retards!

I think this is just stupid. THE PICTURES WERE OF HER, NOT SOMEONE ELSE! Yes, it was stupid to post them on MySpace, so take her damn MySpace down and don't allow her to create another one, she doesn't need a record that will follow her for the rest of her life. Save the sex offender registry for the REAL criminals, like the child rapists. It's not like she posted sex pictures of her with some underage boy. They were of HER. She is a kid, she doesn't deserve to be charged like an adult as she obviously is being 14 and being forced to register as a sex offender if she doesn't comply to the "rules". Even if she were an adult, posting nude photos on MySpace hardly fucking counts as a sex crime.

And as for her parents, where the hell were they?! If you want to blame someone, start with them. It's a parents responsibilty to make sure their child is safe online and not doing anything stupid. Maybe they should get some charges brought upon them for being irresponsible parents and letting their daughter have the privacy to take these nude photos and post them. Who knows what could have happened to her if these pictures had fallen into the wrong hands. She could have met a child preditor and ended up raped, and worse possibly, murdered. And then what would people be saying? "It's the parents fault, they should have kept a better eye on the kid, blah blah blah" But that's true even with THIS situation. This child should NOT have had the oppertunity to even DO this in the first place, but charging her for a sex crime? What? Do they have a damn quota they have to meet for sex crimes too so they have to charge a young girl with a bullshit crime?

The problem with simply taking down her MySpace is...those pictures are still out there. They can take down her MySpace, but once put online, they will always remain in cyberspace. Do you really think no one saved those pictures for their own pleasure? Someone did, and they've probably already posted it on some under-age website. Taking down her page isn't going to make a world of difference.

This is why parents need to take a more active role in their children's lives, ESPECIALLY when their children have access to such forms of media. Not allowing the computer in a private room would be a good start. Requiring access to their under-age child's MySpace would be another good start.

She is actually quite lucky she didn't get slapped with a sex offender rap. What she did, regardless of the fact that it was just her in the pictures, IS promotion of child pornography. She's damn lucky she got off on probation and won't be stuck with the sex offender rap for life. She needs to be glad the judge decided it would be a bad idea to go that route, because she could very well have and honestly, it WOULD have been justified.

There's honestly nothing that can be done about that. Once the pictures were up on her Myspace, the damage was done, and there are probably about a hundred copies of the picture and growing. That's why it's such a serious issue. HOWEVER: I don't think she should be categorized with child molesters and rapists.

You're right, she shouldn't be. BUT, the law says she can be, so really she was quite lucky she wasn't. Had the judge decided she should have, it would have been well within the law for her to be. She better be grateful the judge decided to have mercy on her and not tag her with that title for the rest of her life.

I will never understand why people take naked pictures of themselves. Needn't post them online!!

She is an idiot and needs a good talking to. It's not her parents fault. When you are 14 you know that posting nude pics of your ass online is WRONG! You shouldn't need mummy or daddy to tell you so!

I don't think she should be put on a sex offenders register. I do however think she needs to do some Community Service. Maybe go in to schools and communicate to other teenage girls how ridiculous and embarrassing it is to post naked pics of yourself online!

Totally agree with everything you said! Yes, her parents should have taken a more active roll, but you can't tell me she didn't KNOW better. And if for whatever reason she didn't know better, then her parents are definitely at fault!
