Where's the justice?

A grow of kids go mail-box bashing. A couple that live on that street decide that they should cement the pole into the ground, so they won't keep replacing mail boxes, and their post. The kids decide to go mail-box bashing again. When the kid swings, the force of the swing combined with the cemented post, shatter his arm. He sues, and wins? What are your views?

My view is.... Oh shi....

This happened to my family a while back, as well as several others on our road (quiet back road in the country, of course). It began to happen more and more frequently, so we bought a big mail box, and filled all but what was needed for the mail with cement. I went out a week or two later, and there was a big dent in the side lol. No one sues people with a lot of guns, though =)

i remembering hearing this one case where a homeless man stole a bottle of liquor, got noticed by employees, started running, FELL, cut himself badly, sued the store/company and WON!!!!! so this case doesn't suprise me at all!!

How could they possibly have to pay for that kids stupidity? Since when is it illegal to cement the pole into the ground?

What if the kid had tried to smack down their tree and hurt himself?
I say let him suffer in his own stupidity.

Your topic is exactly how I feel. Where is the justice? The justice is in the fact that the stupid kid shattered his arm. The unbelievable part is that the couple got sued and the kid actually won. He was doing an illegal act, and to my knowledge, cementing a pole into the ground isn't illegal. Sigh. Such a waste of court time.

Well that sounds like it's going right to the court of appeals.

The kid was doing something illegal, and got injured because of it, and won in court over something that wasn't illegal.

Something went wrong in the court proceedings.

True. It doesn't matter what you did and how you did it, and who you hurt in the process. As long as you got a good lawyer, you're in business.

Absolutly. There are hundreds of cases like these. Not same scenario, but pretty damn close. For instance, an intruder was trying to rob another man. The man awoke to someone in his house, and went to grab his gun. He shot the intruder, and the intruder got away. He sued, and won.

This is why I really hope someone doesn't break into my place when I'm there. I'd end up stabbing the bastard and I'd probably be the one to get nailed, not him.

As a matter of fact, if you catch an intruder and you feel "threatened", you can kill them AND get away with it. After all, the best witness is a dead one. ;)

depends on the state and where the body falls. Here in Tx its not too bad - other states you best make sure that body falls somewhere INSIDE your house

That's what I'm saying. If I catch someone on my property attempting to vandalize, I would honestly drag their ass into my house and beat them to death. I guess that's something that has always irritated me, people who have no respect for other's property or things. I mean people work hard and achieve their goals to make money and buy nice things, and shouldn't be ruined by some ungrateful person just out causing trouble.
